The Energy Performance of Buildings Directive obliges member states of the European Union to introduce mandatory energy efficient standards with regard to both commercial and domestic buildings by certifying the energy performance of these types of buildings. The Energy Performance of Buildings (Certificates and Inspections) (England and Wales) Regulations 2007 require an energy performance certificate for all domestic and most commercial buildings when sold or rented out. We have amended Tenancy Agreement forms AGREE1 to AGREE20 to cater for the introduction of energy performance certificates which applied to commercial premises from 6th April and 1st July and to domestic properties on 1st October by inserting a covenant that the tenant will not do anything which will jeopardise the energy efficiency rating of the property, for which the landlord may be held to be liable. Form HA21A has also received a minor amendment. All forms should be used immediately.
