Last November, the Office of Fair Trading published its "Guidance on Unfair Terms in Tenancy Agreements" which attempted to identify those terms and conditions which were potentially unfair in assured and assured shorthold tenancies.

The above forms have now been reviewed in the light of this Guidance and should be used immediately. However, AGREE2D is still being reviewed by the OFT and we are unlikely to be able to supply you with AGREE2D much before the middle of January 2003.

In addition, however, we have taken the opportunity to standardise AGREE3SR, 3A and 3H which create commercial tenancies and so are not covered by the Office of Fair Trading's Report.

Although the existing versions of these three forms can continue to be used, the amended versions of AGREE3SR, 3A and 3H can also be used immediately.
