The Licensing Act 2003 received Royal Assent in July 2003 and replaces the existing system for licensing clubs, public houses, theatres, cafés and restaurants.
The 2003 Act requires licensing authorities to authorise the sale and supply of alcohol and to maintain a register recording detailed information about these licensed establishments.
The Licensing Act 2003 (Personal Licences) Regulations 2005 prescribe the forms to be used by people who do not possess a licensing qualification but who wish to apply for a personal licence on LIC1 or who want to renew a personal licence using LIC2.
LIC3 is used to disclose details of any criminal convictions whilst LIC3a is an application made by someone who already holds an existing licence but who wants to apply for a personal licence between 7th February and 6th August 2005.
The Licensing Act 2003 (Transitional Provisions) Order 2005 prescribes the forms to be used from the first appointed day under the 2003 Act (i.e. 7th February) during the transitional period which will end on the second appointed day which is likely to be in November. LIC3b is the application for someone who holds a justice's licence to convert such a licence to a new premises licence. LIC3c and LIC3d are forms which facilitate this application. LIC3e is an application by a licensed club to convert their existing justices' licence to a new club premises certificate under the 2003 Act.
The Licensing Act 2003 (Premises Licences and Club Premises Certificates) Regulations 2005 prescribe LIC5, 7, 9, 11, 12, 13, 14, 15, 16, 18, 20 and 21 for use in applying for these new types of premises licence and club premises certificates.
The new Licensing rules require certain types of application to be advertised in the local press and publicly displayed on the premises. In the absence of any official forms, we have drafted LIC6, 8, 10, 17 and 19 to be used for these purposes. Practitioners must follow the instructions provided on screen when displaying these forms as public notices on the property.
The Government will confirm the date of the second appointed day by regulations later this year which is likely to be in November. Licensing practitioners will no longer be able to use the forms which we offer under the 1964 Licensing Act after the second appointed day.
