INR9_15 - Creditor's Objecton to a Debt Relief Order (Section 251k)

Pursuant to the publication of the new and amended insolvency forms on EFIS 40 to reflect the introduction of the Insolvency (England and Wales) Rules 2016 on 6th April, Oyez has added several new forms under the 2016 Rules.

In particular, Oyez has drafted a new form under rule 9.5 which can be used by a creditor to object to a debt relief order under the provisions contained in this rule in circumstances where a debt relief order has either been sought or been granted on and after 6th April.

The Insolvency Service has created three other new forms under rules 10.44, 20.4 and 20.5 of the 2016 Rules.

INR10_44 can be used to appeal against the Adjudicator's decision to refuse to make a bankruptcy order.

INR20_4 and INR20_5 can be used to apply for order for non-disclosure of an existing address.

Finally, the High Court has corrected a couple of drafting errors in their new BANK5 and BANK7 forms which you also received on EFIS 40.

BANK1_CC to BANK8_CC have also been added. These forms are amended versions of the High Court forms that can be used in the County Court.

BANK1, BANK2, BANK3, BANK4 and BANK8 have all received slight text or field amendments since our Efis release in April 2017 after customer feedback.
