INR4_8 - Statement of Concurrence

Pursuant to the publication of the new and amended insolvency forms on EFIS 39 which the Insolvency (England and Wales) Rules introduced on 6th April, Oyez has now added to this initial batch of forms by creating new forms for receiverships.

The form numbers refer to the rule number which requires the service of a form or notice under the 2016 Rules.

INR22_4 is a form which the Insolvency Service has drafted for issue to every creditor of an insolvent company which must also be published in the London Gazette no later than 28 days after the completion of an acquisition of the insolvent company under arrangements made by the liquidator or office holder acting as administrator, administrative receiver or supervisor of a creditors' voluntary arrangement (CVA).

All these new forms should only be used for receiverships which have arisen on and after the 2016 Rules came into force on 6th April.

COMP1_CC to COMP8_CC have also been included. These forms are amended versions of the High Court forms that can be used in the County Court.

HR1 form has been updated by the Insolvency Service earlier this year, reference to £5000 fine limit has been removed.

The COMP2, COMP7, COMP8, INR2_25, INR2_25(2), INR2_29, INR3_23, INR6_11, INR6_12, INR6_14 and INR7_61 have all received slight text or field amendments since our Efis release in April 2017 after customer feedback.

All forms can be used immediately.
