GA11 - Application for a Provisional Statement: Form of Notice to Be Published

On 1st September, the Gambling Act 2005 will revoke and replace the Betting, Gaming and Lotteries Act 1963 and the Gaming Act 1968. GA1-GA11 are the new forms for applications under Part 8 of the 2005 Act which are prescribed by the Gambling Act 2005 (Premises, Licences and Provisional Statements) Regulations 2007. Part 8 deals with the issue of premises licences and provisional statements by a local licensing authority.

In general, these Regulations only apply in England and Wales. However, regulation 10(2) - 10 (4) also applies to an application for a provisional statement made to a licensing authority in Scotland where the applicant expects the relevant premises to be constructed or altered in some manner.

Practitioners who want to know how these forms should be used are strongly advised to read the above-mentioned Regulations.

GA1 is the standard form to apply for a premises licence. The new rules require GA5a or GA5b to be served on the responsible authorities which are defined in section 157 of the 2005 Act. GA6 is a notice which the applicant for a premises licence must display on the premises to which GA1 relates.

GA2 is an application to vary the terms of a premises licence and can be used in conjunction with GA7a, GA7b and GA8.

GA3 is an application to transfer a premises licence under section 188 of the 2005 Act and should be used with either GA9a or GA9b.

GA4 is an application for a provisional statement made under section 204 of the 2005 Act and can be used with GA 10a or 10b and GA11.

GA12 is the form prescribed under the Gambling Act 2005 (Club Gaming and Club Machine Permits) Regulations 2007. GA12 is an application for a club gaming or club machine permit but can also be used to renew a permit and apply for a permit under the “fast-track” procedure where the applicant holds a club premises certificate under section 72 of the Licensing Act 2003.

The existing Betting and Gaming Act forms B&G1, B&G3, B&G4, B&G6, B&G9 and B&G10 should not be used after 31st August and therefore need to deleted from your system(s).

The Betting and Gaming category has been replaced by simply Gaming and we therefore advise practitioners to delete the Betting and Gaming category also, before importing this EFIS update.
