The Criminal Legal Aid (General) (Amendment) Regulations 2013 and the Criminal Legal Aid (Financial Resources) (Amendment) Regulations 2013 implement certain changes on 27th January. The Legal Aid Agency has amended CRM14, CRM15, CRM15C and CRM16 to reflect the introduction of a financial eligibility threshold in the Crown Court. Subject to review on the grounds of hardship, any defendant with a disposable household income of £37,500 or more will not qualify for legal aid in the Crown Court. The amended versions of these four forms should only be used for applications submitted on or after 27th January. After we supplied you with all the amended Legal Aid forms on EFIS No.16/2013 in March last year, the Legal Aid Agency made a last minute decision to change CIVAPP6 to facilitate emergency applications by e-mail rather than fax. We therefore request legal aid practitioners to use version 11 of CIVAPP6 immediately.
