The Legal Services Commission has amended CDS1, CDS2, CDS3, CDS4, CDS7, CDS8, CDS10, CDS12 and CDS13 to include a reference to Employment and Support Allowance, to amend the Equal Opportunities and Disability monitoring sections and to reflect current practice and procedures.

CDS14 and CDS15 have been updated in respect of the Employment and Support Allowance and to amend the Equal Opportunities and Disability monitoring sections. CDS16 and CDS17 have been amended by the Legal Services Commission at the request of the Criminal Defence Service to ensure consistency.

CDS18 is a new form which replaces EC_CLAIM1(CRIME) whilst CDS9 will no longer be required after 1st October. Therefore EC_CLAIM1(CRIME) and CDS9 need to be removed from your system(s).

A field has been inserted on CLSAPP1, CLSAPP3, CLSAPP5 and CLSAPP11 whilst an inactive field for use by the Legal Services Commission has been inserted under the title of CLSCLAIM1, CLSCLAIM2 and CLSCLAIM5. A reference to hardship has been deleted from CLSCLAIM4, CLSCLAIM4A and CLSCLAIM4A(NOTES).

CLSMEANS1, CLSMEANS1GUIDE, CLSMEANS2, CLSMEANS7 and CLSCK3 have been updated to include Employment and Support Allowance and to amend outdated references to agencies.

Controlled Work forms CWORK1, CWORK1_2MH, CWORK2(IM) have been updated to include Employment and Support Allowance and to amend the Equal Opportunities and Disability Monitoring Sections. Controlled Work forms CWORK3A, CWORK3B, CWORK3C and CWORK4 have been amended to improve processing. EC_CLAIM1(CIVIL) has been updated to include advocacy and LF1 to include warrant and hardship payments.

The LSC has also made an amendment to LSCFR1 to remove all references to civil files which are no longer valid.

Legal aid practitioners are advised that the use of CDS14, CDS15, CDS16 and CDS17 does not become mandatory until 5th January 2009. However, where an applicant receives Income Based Employment and Support Allowance from 27th October and the case will be heard in the Crown Court, the amended version of CDS14 should be used from 27th October.

All these other amended forms must be used on or after 1st October. However, old versions of these forms which are signed and dated on or before 30th September will still be accepted by the Legal Services Commission until 31st October after which date the old forms will be rejected.
