On the 9th November Mr Justice Mostyn released guidance which updated the Financial Remedy Order 2.1 which provides for a new paragraph "Agreement to refer to Arbitration". This gives the suggested form of words where the parties agree that the whole of the case, or a specific issue within it, should be referred to arbitration.

Orders 1.1, 1.2 and 2.1 have also been amended so that the definitions can now be inserted via check boxes.
