Her Majesty Courts and Tribunals Service (HMCTS) have revised the C100, DIV_A1 and FM1 forms to reflect certain procedural changes.

In particular, HMCTS has amended FM1 and DIV_A1 to reflect a widening of exemptions from attending MIAM which the Civil Legal Aid (Procedure) (Amendment) (No.2) Regulations 2017 introduced on 8th January.

The main changes are the removal of a time limit from when the evidence must date and the addition of several new categories that will now be accepted which mean that victims of domestic violence will find it easier to exempt themselves from attending MIAM.

Although HMCTS amended these forms for use from 8th January, HMCTS will continue to accept the old versions of C100, DIV_A1 and FM1 until 12th January but not for any applications submitted on the old forms after 12th January.

Practitioners may therefore prefer to use the latest versions of C100, DIV_A1 and FM1 for applications completed on and after 8th January.

Finally C1_Flexi has received a minor amendment which can be used immediately.
