The Family Procedure (Amendment No.2) Rules 2016 make various amendments to the Family Procedure Rules 2010 and will come into force on 3rd October.
The Ministry of Justice (MoJ) has amended the Divorce forms A, A1 and B to enable applicants who seek exemption from a Family Mediation Information and Assessment Meeting (MIAM) to provide evidence of domestic violence dating back 60 months instead of the current period of 24 months.
This includes a new exemption on the grounds of financial abuse.
A box has also been added for a mediator's Family Mediation Council (FMC) registration number which will satisfy the courts and judiciary that these forms have been properly signed off by an authorised person.
These amended Divorce forms DIV_A, DIV_A1 and DIV_B should only be used for proceedings which begin on and after 3rd October.
In addition, the MoJ has amended DIV34 for use from 3rd October to enable bailiffs to assess the risks involved when serving the relevant papers on the party to Court proceedings.
Forms EX160 and DIV1_Flexi have received minor amendments.
