In March, the Stationery Office published the Court of Protection (Amendment) Rules 2015.

Some of these amended Rules came into force on 6th April whilst other amendments are scheduled to come into force on 1st July.

The Court of Protection has announced their intention to amend the existing forms COP1, COP1A, COP1B, COP5, COP7, COP8, COP9, COP10, COP20A, COP20B, COP22, COP25, COP30, COP31, COP35 and COP37 on 1st July.

In addition, the Court of Protection intends to produce new annexes which will be numbered COP1C, COP1D, COP1E and COP1F which (like COP1A and COP1B) will provide supporting information for the main application submitted on COP1.

COP2 will become obsolete and should no longer be used.

Although the original statutory instrument was published in March, the Court of Protection has only just advised Oyez of their changes to these forms.

Although the Court of Protection has produced new Practice Directions and sample forms on their website at: http://www.gov.uk/court-of-protection, we understand that the Court of Protection may continue to accept existing versions of the COP forms until the end of August.

However, subscribers should make their own enquiries of the Court of Protection to clarify their policy on and after 1st July.

Oyez will supply subscribers to this range with the new and amended forms as soon as possible in July after all the relevant quality control measures have been completed.
