EFIS 40, April 2014 : Children Act

You must login to download the contents of this EFIS.

The Family Procedure (Amendment No.3) Rules 2013 amend the Family Procedure Rules 2010 to reflect the creation of the new Family Court.

Section 17 of (and Schedules 10 and 11 to) the Crime and Courts Act 2013 create the Family Court and establish the jurisdiction of the new Family Court and High Court to deal with family proceedings.

The 2013 Act removes the jurisdiction of magistrates courts and county courts to deal with family proceedings and enforcement of orders made in this type of case.

The Ministry of Justice has amended the Children Act forms listed to substitute references to residence and contact orders for the new child arrangements orders.

The expandable versions of forms C1_Flexi , C2_Flexi and Word versions of C1_Word, C1A_Word and C2_Word will be released shortly (Version 10 ONLY).
