Section 2113(1) of the Housing Act 2004 stipulates that any deposit for a tenancy paid to secure an assured shorthold tenancy must be handled by the person who receives it in accordance with one of the authorised schemes in force under section 212(1) of the Housing Act 2004.
On 22nd November 2006, the Government awarded three contracts to separate organisations to administer tenancy deposit protection schemes from 6th April 2007.
AGREE21 is a new tenancy agreement form which contains information relating to the "My Deposits" Scheme for protecting tenants deposits.
AGREE22 is a new tenancy agreement form which reflects the requirements of the Tenancy Deposit Scheme.
AGREE23 is a new tenancy agreement form which contains information regarding the rules laid down by the Deposit Protection Service.
Although AGREE 21, AGREE22 and AGREE23 may be primarily of interest to letting agents, they can be used by other professionals as well.
Subscribers to this range should note that Oyez's other Tenancy Agreement forms, AGREE1, AGREE2B, AGREE3, AGREE3B, AGREE3C, AGREE7, AGREE19 and AGREE20 which can be used to create assured shorthold tenancies can still be used in conjunction with the Government's sponsors of tenancy deposit protection.
Forms AGREE19, HA32, L&T35, L&T35A and L&T35B have all received field amendments.
All forms can be used immediately.
