On 28th June, the Home Secretary announced the Government’s intention to limit the number of workers entering the UK from outside the European Union.

On 30th June, the Government asked the independent Migration Advisory Committee (MAC) to launch a 12 week consultation process on the annual limit of the number of non-EU migrants admitted to work in the UK, through Tiers 1 and 2 of the points-based system.

Although no permanent limits on non EU workers will be introduced until April 2011, the Home Secretary also announced the introduction of an interim limit on numbers which will come into force on 19th July.

From 19th July, the UK Border Agency will limit the number of monthly applications received under Tier 1 of the points based system. The UK Border Agency will also increase the pass mark required for Tier 1 applicants from 95 to 100 points.

Unfortunately, the UK Border Agency does not intend to publish an amended Tier 1 form before the interim limit will come into force on 19th July. We will therefore try to supply you with the amended forms as soon after 19th July as possible.

However, we recommend that immigration practitioners consult the relevant sections of the UK Border Agency’s website at www.ukba.homeoffice.gov.uk for more detailed information on the new procedures for the introduction of this interim limit. This is because certain categories under Tier 1 will not be included as part of this interim limit.
