The Transfer of Tribunal Functions (Lands Tribunal and Miscellaneous Amendments) Order 2009 was made under the Tribunals, Courts and Enforcement Act 2007.

Section 3 of this 2007 Act created a two tier structure of tribunals which are called the First-tier Tribunal and the Upper Tribunal.

Part 1 of the 2007 Act enables the functions of existing tribunals to be transferred into the new structure.

The Transfer of Tribunal Functions (Lands Tribunal and Miscellaneous Amendments) Order 2009 transferred the functions of the Lands Tribunal to the Upper Tribunal on 1st June 2009.

Paragraphs 119 and 120 of this 2009 Order amended the Service Charges (Summary of Rights and Obligations and Transitional Provision)(England) Regulations 2007 which prescribe L&T204 and the Administration of Charges (Summary of Rights and Obligations) (England) Regulations 2007 which prescribe L&T205 to reflect these changes.

Landlord and Tenant law practitioners should use the amended versions of L&T204 and L&T205 which refer to Upper Tribunal instead of Lands Tribunal.

Both forms can be used immediately.
