EFIS 20, April 2010 : Right to Manage

The Right to Manage (Prescribed Particulars and Forms) (England) Regulations 2010 amend RTM1, RTM2 and RTM3
on 19th April to take account of changes made to the constitutional documents by the Companies Act 2006 on 1st October 2009.

RTM1 is the notice which a Right to Manage Company serves on certain qualifying tenants which invites these tenants to become members of the RTM company.

After serving RTM1, the RTM company can use RTM2 to acquire the right to manage the premises where the qualifying tenants live.

RTM3 is the response to RTM2 in which the RTM company’s claim is either accepted or rejected.

Practitioners should not use the amended versions of RTM1, RTM2 or RTM3 before 19th April.
