The Parental Responsibility Agreement (Amendment) Regulations 2009 amend C(PRA1) and C(PRA2) to request the gender of the child and prescribe the new C(PRA3) form to record an agreement under section 4ZA of the Children Act 1989 where parental responsibility is acquired by a second female parent. These Rules will come into force on 1st September.

The notes which accompany C(PRA2) have also been amended to recognise that parental responsibility might be held by a former couple, partners or previously entered into by the child’s mother and a second female parent.

The Family Proceedings (Amendment) (No.3) Rules 2009 and the Family Proceedings Courts (Miscellaneous Amendments) (No. 2) Rules 2009 amend C13A as a result of section 38 of the Children and Young Persons Act 2008 which allows a relative to apply for a special guardianship order without the leave of the court where the child has lived with that relative for at least a year.

C19 has been amended by the deletion of a reference to section 33 of the Adoption Act 1976 and the insertion of references to the Children Act 1989 where appropriate on this form.

The amended versions of C(PRA1), C(PRA2), C13A, C19 and the new C(PRA3) form should not be used before 1st September.
