Practitioners are invited to use this latest edition of N235 which the Ministry of Justice has updated to reflect the provisions of the Mental Capacity Act 2005 which came into force last year.

In particular, this latest version of N235 replaces the term ‘patient’ with the term ‘protected party’ and explains that a deputy appointed by the Court of Protection does not need to complete N235 on behalf of a protected party.

This form can be used immediately.
