The Service Charges (Summary of Rights and Obligations and Transitional Provision) (England) Regulations 2007 prescribe L&T204 as the form which must accompany any demand by a landlord for a tenant to pay his or her service charges.
L&T204 summarises a tenant’s rights and obligations but these 2007 Regulations do not apply where the lease is not a long lease under section 26 of the Landlord and Tenant Act 1985 or where a landlord is a Local Authority, a National Park Authority or a New Town Corporation.
The Administration Charges (Summary of Rights and Obligations) (England) Regulations 2007 prescribe L&T205 as a summary of a tenant’s rights and obligations with regard to administration charges and must accompany any demand for payment served by a landlord on his or her tenant.
Since both sets of Regulations will not come into force in England until 1st October 2007, practitioners should therefore not use these new forms before this date.
