The Immigration (Leave to Remain) (Prescribed Forms and Procedures) Regulations 2006 revoked and replaced the Immigration (Leave to Remain) (Prescribed Forms and Procedures) (No. 2) Regulations 2005 on 22nd June.

However, transitional provisions in regulation 16(2) expressly allowed existing forms to be submitted “…if made within 21 days of the Regulations coming into force.”

In particular, these 2006 Regulations have added new questions to the official BUS, FLR(M), FLR(O), FLR(S), FLR(SEGS), FLR(FT_WISS), SET(F), SET(M) and SET(O) forms to reflect changes to the Immigration Rules concerning certain categories of applicants.

The Immigration and Nationality Directorate of the Home Office has also updated the non-prescribed applications submitted on the COA, ELR, NTL and TOC forms.

Immigration practitioners can use the amended forms on receipt of this information.

Forms affected

FLR(M) Application for an extension of stay in the UK in one of the following categories: Spouse or civil partner of a person present and settled in the UK; Unmarried or same sex partner of a person present and settled in the UK New/Amended
NTL Application for an indefinite leave (no time limit) stamp to be fixed on a passport or other document issued to someone who already has indefinite leave to enter or remain in the United Kingdom, etc. New/Amended
FLR(S) Application for an extension of stay in the UK in one of the following categories: Student, Student undertaking examination re-sites, Postgraduate student writing up thesis, Student nurse, Prospective student, Sabbatical officer New/Amended
FLR(O) Application for an extension of stay in the UK in one of the following categories: Visitor, Overseas qualified nurse or midwife, postgraduate doctor or dentist, Au pair, UK ancestry, Employment not requiring a work permit, Writer, composor etc. New/Amended
FLR(IED) Application for an extension of stay (limited leave to remain) in the United Kingdom as the holder of immigration employment document - see Section 4. New/Amended
SET(M) Application for indefinite leave to remain in the UK, in one of the following categories, having completed a period of 2 years in the category: Spouse or civil partner, Unmarried or same sex partner of a person present and settled in the UK. New/Amended
SET(O) Application for indefinite leave to remain in the UK in one of the following categories: Work permit holder; Employment not requiring a work permit; Writer, composer or artist; UK ancestry; Highly Skilled Migrant Programme; etc New/Amended
SET(F) Application for indefinite leave to remain in the UK as a family member other than the spouse, civil partner, unmarried or same-sex partner of a person present and settled in the UK. Child under the age of 18 of a parent, parents or a relative. New/Amended
COA Application for a certificate of approval for marriage or civil partnership in the United Kingdom New/Amended
ELR Application for indefinite leave to remain in the UK on completion of 4 years' exceptional leave to enter or remain granted before 1 April 2003 following the refusal of asylum. New/Amended
FLR(SEGS) Application for an extension of stay in the UK under the Science and Engineering Graduates Scheme (SEGS) New/Amended
BUS Application for an extension of stay or indefinite leave to remain in the UK in one of the following categories: Business person, Sole representative, Retired person of independent means, Investor, Innovator New/Amended
TOC Application for a limited leave (transfer of conditions) stamp to be fixed on a passport or other document by someone who already has limited leave to enter or remain in the United Kingdom, where this stamp was previously fixed etc. New/Amended
FLR(FT_WISS) Application for an extension of stay in the UK under the Fresh Talent: Working in Scotland Scheme (FT:WISS) New/Amended
