On EFIS 68/2005, we advised subscribers to this range of amendments to EP2 which had been re-prescribed by the Court of Protection Enduring Powers of Attorney (Amendment No. 2) Rules 2005.

However, rule 3 of these 2005 Rules specifically allowed the current edition of EP2 to be submitted until 1st April 2007 which is when the Mental Capacity Act 2005 will be implemented.

We now enclose the updated version of EP2.

The Public Guardianship Office uses scanning technology to process the completed version of EP2. Although the Public Guardianship Office has not formally approved the precise configuration of this form due to changes in the technology used to scan EP2, the Public Guardianship Office will process it because EP2 is a statutory form which Parliament has approved by secondary legislation.

We have made a minor field amendment to CP5 which is also available.

Both forms can be used immediately.
