Following the amendments which were made to these forms on EFIS No. 68 in November 2005, we have increased the space at the foot of each page to facilitate attestation under section 3 of the Powers of Attorney Act 1971.

Practitioners will recall that the Enduring Powers of Attorney (Prescribed Form) (Amendment) Regulations 2005 expressly permitted the use of the old edition of CON36E until 1st April 2007.

This is because the current forms will be replaced by new Lasting Power of Attorney (LPA) forms next April when the Mental Capacity Act 2005 will come into force.

At present, the Department for Constitutional Affairs (DCA) is conducting a consultation exercise on the contents of these LPA forms and we will keep you informed of any further developments, next year.

Both forms are available for your immediate use.
