The Enduring Power of Attorney (Prescribed Form) (Amendment) Regulations 2005 represcribe CON36E.

Although these Rules will come into force on 5th December 2005, Regulation 3 of these 2005 Rules permits the use of the current form until 1st April 2007.

Please note the amended version of CON36E and its Continuation Sheet cannot be used before 5th December.

The Court of Protection Enduring Powers of Attorney (Amendment No. 2) Rules 2005 also represcribes form EP2 from 5th December.

EP2 incorporates reference to "civil partners" in recognition of the Civil Partnership Act 2004 which will come into force in December.

However, rule 3 of these 2005 Rules allows the current version of EP2 to be used until 1st April 2007.

We will supply practitioners with EP2 when the Public Guardianship Office has approved the amended forms for use with its MERIS computer system
