EFIS 34, July 2005 : Insolvency Partnership/Estates

The Insolvent Partnerships (Amendment) Order 2005 has amended Insolvency Partnership Forms 1 and 4 to take account of changes to the administration procedure introduced under the Enterprise Act 2002.

INP_1 has been represcribed as an application for administration of an insolvent partnership rather than a petition to wind up the same.

INP_1A is a new form where the members of a partnership give notice of their intention to appoint an administrator or an agricultural receiver of the partnership.

INP_1B is a similar notice to INP_1A but is used where no notice of intention to appoint has been issued by the members of the partnership.

Also, minor amendments have been made to INP_4.

The Insolvent Partnerships (Amendment) Order 2005 came into force on 1st July.
