The Legal Services Commission has updated CLSCLAIM1 and CLSCLAIM2 to take account of increases made to the assessment limits, following abolition of the discretionary assessment limit. In future, the LSC must assess all claims where no proceedings have been issued and all costs claimed of Ł2,500 or less where proceedings were issued.
This update contains new versions of forms CLSCLAIM1 and CLSCLAIM2, which become effective from 1st July and mandatory from 1st August.
The Legal Services Commission has warned practitioners who submit out of date versions of CLSCLAIM1 and CLSCLAIM2 after 1st August that their applications could be rejected.
In addition, the Legal Services Commission has provided practitioners with two new checklists to help them complete CLSCLAIM1 and CLSCLAIM2. Practitioners are advised to consult the checklists before filling in either CLSCLAIM1or CLSCLAIM2.
The revised guidance and updated forms become effective from 1st July and mandatory from 1st August when only these updated forms should be used. Therefore, we recommend that legal aid practitioners use the amended forms from 1st July onwards. Additionally, we have made minor textural and alignment changes to forms CMRF and CMSF, which are included on this update.
Finally, we have made a slight macro amendment to form CLSCLAIM5.
