EFIS 6, February 2003 : Court of Protection

The Court of Protection (Enduring Powers of Attorney) (Amendment No. 2) Rules 2002 were produced last year when some of its provisions came into force on 31st August.

However, these Rules also re-prescribed an amended version of EP2, which must be used from 28th February 2003, onwards.

Practitioners will note substantial differences between this amended form and the current version of EP2. In particular, the revised form differs in so far as: -

1) details of up to three attorneys can now be provided on EP2
2) a new section for an address for correspondence is included in the form
3) a bar code has been inserted to enable the Public Guardianship Office to scan the information submitted on the completed application form.

CP3 has been updated to reflect substantial changes introduced last year. CON36D has also a minor amendment to its wording to clarify the applicability of the Trustee Delegation Act 1999 to the creation of the power of attorney. Both these forms can be used immediately upon receipt.

Finally, we have added EP1(3) which is an adapted version of EP1 allowing for 3 attorneys.
