The Building (Amendment) Regulations 2002 came into force on 1st April and introduced new regulations relating to the installation or replacement of windows and doors. The Glass and Glazing Federation (GGF) has created a self-assessment scheme called FENSA for its members.

In future, all replacement windows, roof lights, roof windows and glazed doors will need to comply with the Building Regulations and solicitors will need to ensure that either the work has been certified by FENSA or enjoys the benefit of a certificate issued by the Local Authority Building Control.

These new procedures apply to all contracts signed on or after 1st April 2002. Where orders were placed before 1st April, this new procedure will not apply if the work was completed before 1st July 2002.

The Law Society has amended Prop 1 to incorporate these new arrangements which will also form part of the National Conveyancing Protocol from 31st October and Con 29 (Long) has also been updated to reflect these new procedures.

An article explaining the background to these changes appeared in The Law Society's Gazette on 30th August. Although practitioners can continue to use the second edition of Prop 1 (suitably amended), we would recommend that practitioners use the third edition of Prop 1 on receipt of this e-mail

Finally, we have taken this opportunity to enclose copies of Prop forms 3, 4, 6, 7, and LS1 and LS2 which have merely been amended to incorporate the new Law Society's logo.
