The Civil Procedure (Amendment No. 3) Rules 2000 stipulate new funding arrangements for legally aided claims following the introduction of the Access to Justice Act 1999 on 1st April.
The Court Service have revised N253, N258 and N258A to take account of these changes and introduced two new forms N258B and N258C.
N258B is a request for assessment of costs which are payable out of a central fund. N258C is a request for an assessment of costs following an order made under the Solicitors Act 1974.
N260 was formerly COSTS1 and has now been renumbered (as well as amended).
In addition to the above amendments :
Form N208C has also been amended with regard to notes N208C which accompany this form. These amendments affect the section concerning the Statement of Truth.
N244. A two-page version of this form is attached, as some users have experienced difficulties with certain courts who will not accept the four-page version. Users will have the choice of using either the two-page or the four-page N244 which are now called N244(2PG and N244(4PG.
In addition to the new and amended forms outlined above, we have also added the following form to the CPR range.
