The Family Proceedings (Amendment No. 2) Rules 1999 create a new procedural scheme for ancillary relief applications under the Matrimonial Causes Act 1973.
In particular, these Rules prescribe forms for use in such proceedings which are supplied on the disk which accompanies this letter.
Practitioners should read the Family Proceedings (Amendment No.2) Rules 1999 for themselves to appreciate how and when these new forms should be used.
Although these Rules do not come into force until 5th June, paragraph 1(3) enables the court to direct that these Rules may be applied to proceedings begun before 5th June where the court considers it “just” to so direct.
Practitioners must therefore check with their local court to see if they will accept these new and amended forms before 5th June.
Divorce forms 97, 99, 103, 104 and 105 cannot be used after 5th June. You may wish to delete them from your system at that point in time. Please see enclosed instructions.
