On 14th December 2015, the Land Registry issued a press release concerning the witnessing of deeds which you can read for yourself by following the link below at: www.gov.uk/government/news/witnessing-of-deeds

As you will see, the Land Registry amended section 2.1.2 of their publication concerning "Execution of Deeds" to clarify their policy in relation to attestation.

In particular, the Land Registry has reiterated their position that when two or more people execute a deed, the same witness can witness each individual signature but that each signature should be separately attested in accordance with sections 1(2) and 1(3) of the Law of Property Miscellaneous Provisions) Act 1989 and rule 206 of the Land Registration Rules 2003.

From 18th January, the Land Registry will therefore raise a requisition where a deed has only one attestation and it is not clear on the face of the deed that it applies to all the signatures.

Subscribers to the Conveyancing range who have any questions regarding the attestation of those Land Registry forms which are deeds should contact their local district Land Registry office for more detailed information.

The Land Registry will not apply this new procedure in respect of deeds which are completed before 18th January.
