On EFIS No. 40 in June 2006, we supplied you with Oyez’s new forms of lease which had been updated in accordance with rules 5 and 8 of the Land Registration (Amendment No. 2) Rules 2005.

Rules 5 and 8 prescribed certain clauses which had to be incorporated in any new leases created after 19th June for a period of seven years or more.

The Law Society has now replaced its two existing forms with four new forms of business lease. LS1 and LS2 have been separated into individual leases which cater for registered and unregistered title. Therefore, we recommend practitioners delete forms LS1 and LS2 from their system(s) on receipt of this update.

Practitioners who would like to understand more about the drafting of these four new leases can read Emma Slessenger’s article on page 23 of September’s edition of “Property in Practice” which is a magazine produced by the Law Society’s Property Section.

An article concerning these amendments may also be inserted in a subsequent edition of the Law Society’s Gazette.
