The Family Proceedings Fees (Amendment No. 2) Order 2005 prescribe new and increased fees which became payable on 10th January.

The Statutory Instrument also contains the fees payable when applying for the dissolution or annulment of a civil partnership or for a legal separation under the Civil Partnership Act 2004.

We have increased the fee which appears on the notes which accompany DIV93 from £20 to £25 for each decade searched in the divorce index record at the Principal Registry in London.

DIV93 remains unchanged by this update.

In addition, the Court Service has made some minor amendments to EX160 and its accompanying Notes to take account of the Civil Partnership Act 2004 which came into force on 5th December last year.

Although the current edition of EX160 and Notes can continue to be used where civil partners do not apply for the exemption or remission of court fees, we recommend that practitioners should use the revised Form and Notes immediately.

Please also find enclosed the DIV_E, DIV8 and DIV100 which have all received minor field amendments.

All forms can be used immediately.
